Defense Team Secures Complete Summary Judgment Victory in Correctional Healthcare Litigation
Teague Campbell attorneys Matt Little, Megan Silver, and Kasey McCalla secured a complete summary judgment victory for IMS Correctional Healthcare, LLC (“IMS”) and two health care providers in litigation arising from a 2022 inmate death at a local jail.
Plaintiff sought to impose liability on IMS and the health care providers for medical malpractice and deliberate indifference. After extensive discovery, including surveillance video and witness testimony, the defense established that the health care providers were not deliberately indifferent to Plaintiff’s medical needs. Further, the Court granted the defendants’ Motion in Limine to exclude Plaintiff’s expert testimony. The Motion in Limine attacked the Plaintiff’s expert’s qualifications and reports. The defense also established the materials Plaintiff’s Rule 9(j) expert reviewed were insufficient and that Plaintiff failed to designate a qualified expert to testify regarding the standard of care. The Court also dismissed Plaintiff’s malpractice claim.
In granting summary judgment, the United States District Court for the Middle District of North Carolina held that Plaintiff’s Monell claim failed for lack of a constitutional violation and lack of proximate cause and entered judgment in favor of IMS and the health care providers on all claims.
