Favorable Jury Verdict in Wake County Trial
Matt Little and Kasey McCalla defended a two-week jury trial in Wake County Superior Court and received a very favorable verdict. The case involved multiple defendants with allegations of intentional infliction of emotional distress, negligent infliction of emotional distress, battery, and premises liability based on failure to provide security.
Mr. Little and Ms. McCalla defended an individual defendant with admitted liability as to battery, which meant the jury was only required to consider damages as to that issue.
The jury returned a defense verdict on the issues of intentional infliction of emotional distress and negligent infliction of emotional distress. The plaintiff requested that the jury award total damages of $14.55 million and received a verdict of $1,000 in collectable damages as to premises liability and $50,000 in uncollectable damages.
The favorable verdict follows months of intensive litigation efforts, including document review, depositions, motion practice, expert retention and analysis, and trial preparation. Our attorneys worked collaboratively with other defense counsel and developed strategies to achieve this outcome.
