Matt Little Obtains Directed Verdict in Products Liability Case
Teague Campbell attorneys Matt Little and Lindsey Revels tried a product liability case for St. Clair Foods, a food manufacturer from Memphis, Tennessee, in Wake County Superior Court before the Honorable Carl Fox. The case involved issues of negligence and breach of the implied warranty of merchantability related to an allegation of food poisoning. The trial lasted four days and plaintiff put on witnesses from the Wake County Health Department, medical experts as well as lay witnesses. Testifying for the defense was the plant manager for St. Clair Foods, Dennis Spence. At the end of plaintiff’s evidence, Judge Fox determined that plaintiff had failed to present any evidence of negligence by St. Clair Foods or that there was a contamination problem at its production facility and directed a verdict in favor of the defense.
