WC Update: The NC Supreme Court Will Hear Wilkes

The North Carolina Supreme Court has granted the City of Greenville’s Petition for Discretionary Review in Wilkes v. City of Greenville, which was reported in the October 2015 Risk Alert. As such, the Court will be reviewing the Wilkes holding that defendants have the burden of rebutting the presumption that all subsequent injuries are compensable, even for injuries that were not initially accepted on the Form 60 and are otherwise seemingly unrelated to the accepted injury.
